The Story Mob is a company providing communications and public relation services in the video games and esports sector, and we have created a Privacy Policy that aims to help you understand what data we collect, what we use it for and how you can exercise your rights.

We respect your right to privacy and will only process personal information in accordance with applicable legislation (which includes the California Civil Code and Business and Professions Code and the General Data Protection Regulation (EU) 2016/679 (“GDPR”).

This Privacy Policy covers The Story Mob website (https://www.thestorymob.com/) and the services provided by us, including but not limited to emails, company updates, the contact form on our Website and other communications (“Services”). The Story Mob qualifies as data controller under the GDPR with regard to personal data referred to in this Privacy Policy.

The Story Mob adheres the following principles in order to protect your privacy:

  • we do not collect more information than is necessary; we do not use your data for purposes other than those specified; we do not keep your data if it is no longer needed; we do not share your data with third parties.

I. Applicable laws

The Story Mob as controller is established in California, the European Union and in the United Kingdom. If you are as data subject located in California, the following general considerations will apply under (II) and the considerations specifically addressed to those concerned in California under (III).

The Story Mob may also process personal information of data subjects who are resident in the European Economic Area (“EEA”: the countries of the European Union as well as Norway, Liechtenstein and Island) as The Story Mob also offers its Services within the European Union. Therefore, if you are as data subject located in the EEA, the following general considerations will apply under (II) and the considerations specifically addressed to those concerned in the EEA under (IV).

In any other case, the general conditions under (II) at least apply to all our Services and data subjects. For the avoidance of doubt, the inclusion of the section: those concerned in the EEA, those concerned in California and/or any reference to non-US residents in this Privacy Policy, does not obligate The Story Mob in any way to allow or to prove, that non-US residents participate in our Services.

II. General considerations

1. Scope of the Privacy Policy

This Privacy Policy is applicable to the Services offered by The Story Mob directly via our Website. Our Website contains links to other Websites. Once redirected to another Website, this Policy is no longer applicable. This version of the Privacy Policy is effective from May 2018.

Our Website features two plug-ins for easy sharing and following our social media pages: Facebook, operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA; and LinkedIn, operated by LinkedIn, 2029 Stierlin Court Mountain View, CA 94043 United States. Being on our Website does not result in sharing data on these social media networks. These plugins remain inactive (idle) until clicked upon. Once clicked upon, you will be taken to the said social media networks with their own specific privacy policies you are recommended to consult. For more information about how these social media platforms handle your data, we refer to the relevant privacy policies of these organizations.

2. What information do we collect, from whom and how do we use it?

2.1. When you visit our Website

Anyone can visit our Website without giving away your personal information. The Story Mob uses Google Analytics and Cookies in order to improve our Services, user experience and to analyze how the Website is used. We do not use cookies to track your movements or place any advertisements. In this regard, we also refer to our Cookie Policy.

Aside from the approximate location (IP address), the information collected by Google Analytics is anonymous traffic data including browser information, device information and language. We do not collect additional information, such as your age, gender, interests, bank details or clickstream. The collected information is used to provide an overview of how people are accessing and using The Story Mob Website. It is not used for any additional purpose, such as to profile those who access our Website.

2.2. When you contact us and access our Services

While you can use our Website without giving away any personal information, once you contact us via our Website, The Story Mob collects information about you. The information you fill in via the contact form (your first and last name, email address and (if applicable) your organization) will be processed and stored in order for us to get in touch with you, respond to your request, to provide you with our whitepapers and guides, to keep you in the loop on new releases, for our administration and/or allow you access to our Services.

2.3. Employees and recruitment

If you work with or for The Story Mob or apply for a job or internship, we will collect, process and store the information you have sent us for work-related and recruitment-related purposes, such as sending you information about your relationship or transactions with us and for our (financial) administration. Additionally, if you apply for a job or internship at The Story Mob and if you have given your consent, we may keep your data for at least one year for the purpose of considering you for a different opportunity.

3. Information Security

The Story Mob cares to ensure the security of personal data and keep it confidential (unless it is non-confidential by nature, for example, publicly-available information). When The Story Mob collects information about you, we make sure that your information is protected from unauthorized access, loss, manipulation, falsification, destruction or unauthorized disclosure. This is done through appropriate technical measures.

In addition, if we make use of a data processor or another third party, we will ensure the level of data protection through data processing agreements. Even within The Story Mob-group, we entered into Services Agreements between different companies established within the European Union, UK and the US.

4. Retention periods

In any case, we will not retain or use your personal information longer than necessary for the purposes outlined in this Privacy Policy. We will delete your personal information if you, for example request the deletion, if you withdraw your consent or if you terminate your contract with us.

As an exception, we will not delete your personal information where we still have a legitimate interest to use your personal information, to the extent permitted by law. For example, we may still retain your personal information to resolve disputes or comply with legal requirements. In this case, your personal information will be blocked from use for any other purposes.

5. Your rights

5.1. Access to information

You have the right to request access the information we have on you. We will make sure to provide you with a copy of the data we process about you. In order to comply with your request, we may ask you to verify your identity. If we receive or make a copy of your identity card, we will ask you to make the following parts unreadable on your identity card: photo, MRZ (machine, readable zone), card number and the identification number. We will fulfill your request by sending your copy electronically, unless the request expressly specifies a different method. For any further requested copies, we may charge you with an administrative fee.

5.2. Information correction

If you believe that the information we have on you is incorrect, you are welcome to contact us so we can update and correct your personal data and keep it accurate.

5.3. Information deletion

If at any point you wish for The Story Mob to delete information about you, you can simply contact us.

6. Changes to the Privacy Policy

We reserve the right to change this Privacy Policy. We constantly review our Privacy Policy and strive towards making it better. The Story Mob will not reduce your rights stated in this Policy without asking for explicit prior consent to the changes. All changes to our Privacy Policy will be available on our Website.

III. California Privacy Rights

1. California Consumer Privacy Act

The California Consumer Privacy Act of 2018 (the “CCPA”) grants you the following rights with regard to the personal information we collect about you: (i) the right to know what personal information we have collected about you, and the purpose for which it was collected; (ii) the right to request that we delete any personal information we have collected from you (subject to certain exceptions, as outlined in the CCPA); (iii) the right to opt-out of the sale of your personal information; and (iv) the right to non-discrimination for exercising your rights herein.

We do not share your personal information with unaffiliated third parties for their own direct marketing purposes, without your approval. Furthermore, we do not sell your personal information to third parties.

2. California Minors

Since January 1, 2015, California Business and Professions Code Section 22581 permits you, if you are a California resident under the age of 18, to view, correct, or delete information provided by you or publicly posted by you. You may do this by contacting us at contact@thestorymob.com.

We will be happy to review, update or remove information and/or content as appropriate. Residual copies of information and/or content that have been deleted may remain in our backup systems. We may still retain your information to resolve disputes, enforce our legal rights, or comply with legal requirements; in this case, your personal information will be blocked from use for any other purpose.

3. Do Not Track

Although we respect and value your privacy, The Story Mob website does not currently respond to “Do Not Track” (DNT) signals and operates as described in this Privacy Policy regardless of whether a DNT signal is received.

IV. Considerations specifically addressed to those concerned in the EEA

The Story Mob will only process personal information if we can rely on legal grounds as mentioned in the GDPR. We will process your personal information for the purposes set out below.

1.1. Performance of an agreement for our Services (Article 6 (1) (b) GDPR)

We process your personal information for the performance of an agreement for our Services, to provide or support our Services or for any other request regarding our Services. For example, to provide you with global customer service or to get in touch with you.

1.2. Your consent (Article 6 (1) (a) GDPR)

We process your personal information if you have given consent to the processing of your personal information for one or more specific purposes. For example, to provide updates or other direct marketing communications, (if necessary) to set forth certain information to third parties or to process your information for a longer period of time than the original retention period.

1.3. Legitimate interest (Article 6 (1) (f) GDPR)

We process your personal data if processing is necessary for the purposes of the legitimate interests pursued by us. For example for the establishment, exercise or defense of legal claims or whenever courts are acting in their judicial capacity.

1.4. Legal obligation (Article 6 (1) (c) GDPR)

We process your personal information if the processing is necessary for compliance with a legal obligation to which we are subject.

2. Data subject rights

If you are located in the EEA, you will have four additional rights besides the aforementioned rights to view, correct or delete your personal information.

2.1. Object to the processing

You may object to the processing of your personal information, based on a legitimate interest and on ground relating to your particular situation.

2.2. Restricting the processing

In certain circumstances, you have the right to obtain from us the restriction of our processing. For example, if the accuracy of your personal data is contested or if we no longer need your personal data for the purposes of the processing.

2.3. Transfer of information

In certain circumstances, you can request that we transfer your personal information that you have provided to us to another controller.

2.4. Withdraw consent

If we rely on your consent in order to process your personal information, you have the right to withdraw your consent at any time. You will also control the extent to which we send updates and direct marketing messages to you and you have the right to request that we stop sending the marketing messages at any time.

However, if you have unresolved concerns with regard to our data processing, you also have the right to complain to the national data protection authorities. You can bring your complaint in the member state of your residence, place of work or where an alleged infringement of data protection law occurred.

The Story Mob is not obliged to designate a representative in the European Union according to Article 27 of the GDPR since the processing is only occasional and does not include the processing of special categories of data, nor the processing of personal data relating to criminal convictions and offences and is unlikely to result in any risk.

3. (International) data transfers

The Story Mob does not process much personal data as we are not a data-driven company. Nevertheless, when your personal information will be processed in the United States, where many of our datacenters operate, we use Standard Contractual Clauses as approved by the European Commission to protect your personal information. Even within The Story Mob-group we enter into Services Agreements between different companies established within the European Union, UK and the US (EU controller The Story Mob GmbH to non-EU controller The Story Mob LLC).

In addition, we will share your personal information if we are required to do so by (international) laws, including but not limited to disclosure to law enforcement or other government officials. If you have any questions regarding this, please contact us.

V. To conclude

In accordance with the applicable laws, we only collect a limited amount of information about you that is necessary for improving and using our Services. We do not use (automated) profiling, we do not sell or in any other way share your data to third parties, we do not use your data for purposes other than what we have specified in this Policy. We also make sure that your data is stored securely and we delete all information deemed no longer necessary.
